Welcome to Borrow Money・Cash Over Credit. These Terms of Use ("Terms") form a binding agreement between you ("User," "you," or "your") and CASH OVER CREDIT LLC ("Company," "we," "us," or "our"). These Terms govern your use of the Borrow Money・Cash Over Credit mobile application (the "App") and any associated services. Please review them carefully. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the App.

1. Our Services

Borrow Money・Cash Over Credit provides a platform that allows users to connect with independent third-party lenders ("Lenders"). We do not provide loans, make credit decisions, or act as a lender. Borrow Money・Cash Over Credit facilitates your submission of loan requests and may display loan offers from Lenders based on the information you provide.

We do not guarantee approval for any loan, the amount of any loan, or specific terms such as interest rates or repayment periods. Any loan agreement you enter into is solely between you and the Lender.

1.1 Loan Terms

The Annual Percentage Rate (APR) for loans available through the App generally ranges from 6.99% to 35.99%. Your individual rate and terms will depend on your credit profile, income, and other factors determined by the Lender.

1.2 Repayment Terms

Repayment periods available through lenders typically range from 3 months (90 days) to 24 months. The specific repayment schedule and terms will be provided by the individual Lender.

2. Eligibility

To use the App, you must be at least 18 years of age and a legal resident of the United States. By using the App, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.

3. Account Registration and Security

Certain features of the App may require you to create an account. You agree to provide accurate, complete, and current information and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

We reserve the right to suspend or terminate your account if we suspect any fraudulent, abusive, or unlawful activity.

4. Loan Offers and Third-Party Lenders

Borrow Money・Cash Over Credit is not a party to any agreement between you and a Lender. We do not endorse, recommend, or guarantee the products or services of any Lender. It is your responsibility to carefully review all terms and conditions of any loan offer before accepting it.

5. No Guarantee of Approval

Submission of a loan request does not guarantee that you will receive a loan offer or be approved for a loan. Approval decisions are made solely by the Lenders based on their criteria.

6. Fees and Charges

Borrow Money・Cash Over Credit does not charge you any fees for using the App or submitting a loan request. However, Lenders may impose various fees, including but not limited to origination fees, late payment fees, non-sufficient funds fees, and applicable interest charges. You are solely responsible for reviewing and agreeing to any fees associated with a loan offer.

7. User Conduct

By using the App, you agree not to:

• Violate any applicable law or regulation.
• Provide false or misleading information.
• Attempt to interfere with or disrupt the operation of the App.
• Access data not intended for you.
• Attempt to breach the security of the App.

8. Privacy and Data Collection

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties, express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will operate without interruption, be free from errors, or be completely secure.

10. Limitation of Liability

To the fullest extent permitted by law, CASH OVER CREDIT LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App or your interactions with Lenders.

11. Indemnification

You agree to indemnify and hold harmless CASH OVER CREDIT LLC, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from your violation of these Terms or your use of the App.

12. Changes to These Terms

We may revise these Terms at any time. Changes will become effective upon posting within the App. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising out of these Terms or your use of the App shall be resolved through binding arbitration conducted in Wyoming, except where prohibited by law.
